You may purchase items on this Site through our electronic shopping cart process. In addition to the Terms, the following policies shall apply to all online orders and sales.

Purchase Disclaimer

All payments must be made in advance of shipping, and must be made via credit card. All purchases are final and no returns will be accepted, unless a manufacturing quality defect is verified by G3.

Validating Your Order
After you place an order using our shopping cart, we will check the information you give us for validity by verifying your method of payment (e.g. billing address if using a credit card) and/or shipping address. We reserve the right to reject any order you place with us, and/or to limit quantities on any order, without giving any reason. If we reject your order, we will attempt to notify you using the telephone number, e-mail, and/or billing address you have given us with the order. Your credit or debit card will normally not be charged if we reject an order, but we will process a refund if the charge has been made against your card.

Order Acceptance/Confirmation
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

Limited Quantities 
We may, at our discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by the same Site account, the same credit card, and orders that use the same billing and/or shipping address. In the event we make a change or cancel an order, we will attempt to notify you by contacting you at the telephone number, e-mail address, and/or billing address provided at the time the order was made.

Inventory and Substitutions
Though we continually monitor our inventory to ensure product availability, there are times when products may be out of stock. We will call or e-mail you to determine if you would like to wait for the product to be in stock, substitute other items, or cancel part or all of the order. In cases where a substitution is necessary, we will contact you before shipping and provide the option to select other items. If you decide not to make a substitution, we will ship available items minus the out of stock item(s) or cancel the order if you prefer to do so.

Third Party Processing Orders
We use a third party supplier, BigCommerce, to provide shopping cart services on the Site. BigCommerce uses multiple layers of security when it collects, processes and stores all order data as necessary to perform its function. Our Privacy Policy has additional detail about how we collect and use information we receive from you.

Payment 
We accept payment through the following credit cards: Visa®, American Express® and MasterCard®.

Shipping
All orders placed on this Site are subject to product availability and will be shipped according to our Shipping Policy.

You are responsible for all shipping charges unless we agree otherwise in writing. Shipping charges will be calculated during the online ordering process. Shipping and handling charges are nonrefundable unless we send the wrong item.

In our experience, you are likely to receive a shipment sooner if an adult will be available to sign for shipments at the “Ship To” address during business hours. For that reason we recommend using a business address. We cannot ship to P.O. boxes.

Warranty
Seller warrants that the goods supplied to you in fulfillment of orders placed on this Site will conform to the descriptions provided by G3 on this Site, and that Seller will convey good title thereto SELLER MAKES NO WARRANTY THAT THE GOODS SHALL BE MERCHANTABLE OR FIT FOR ANY PARTICULAR PURPOSE. SELLER MAKES NO WARRANTY, EXPRESS OR IMPLIED, EXCEPT SUCH AS ARE EXPRESSLY SET FORTH IN THIS ONLINE STORE POLICY. IN NO EVENT SHALL SELLER BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO ANY GOODS SOLD BY SELLER. Seller's liability and Buyer's exclusive remedy for any breach of warranty is expressly limited to, at Seller's option, the repair of defective goods, or the replacement thereof with conforming goods, or the repayment of the purchase price. Seller's liability for damages shall in no case exceed the purchase of the particular quantity of goods delivered with respect to which damages are claimed. Replacement of defective goods or repayment of their purchase price will be made only after inspection by Seller and return of such goods at the cost of the Seller, in accordance with shipping instructions given to Buyer by Seller. Claims under this limited warranty must be made in writing within fifteen (15) business days of the shipment date. Buyer's failure to make a claim within said fifteen business days shall be a waiver of that claim unless such claim is the result of a latent defect that could not be detected by Buyer upon reasonable inspection, in which case Buyer's failure to make a claim within three (3) months from shipment shall be a waiver of that claim.

Waiver
No waiver by Seller of any breach of any provisions hereof shall constitute a waiver of any other breach or of such provision. SELLER'S FAILURE TO OBJECT TO PROVISIONS CONTAINED IN ANY COMMUNICATION FROM BUYER SHALL NOT BE DEEMED AN ACCEPTANCE OF SUCH PROVISIONS OR AS A WAIVER OF THE PROVISIONS OF THIS CONTRACT.

Technical Advice
Technical advice furnished to Buyer by G3 before or after delivery in regard to the use of said goods that is furnished without charge, is furnished on the basis that it represents Seller's best judgment under the circumstances and is to be used or acted upon at Buyer's sole risk.

Indemnity
Buyer shall release, hold harmless, indemnify and defend Seller from and against any loss, liability, claims, suits and costs caused by, arising out of, or relating to the design of goods supplied hereunder or the design of the packages or containers in which they are shipped, if such goods, packages or containers were made to Buyer's design or specifications.

Term of Sale
Terms of sale and delivery are only expressed as set forth in this Online Store Policy. No other terms, warranties, conditions, agreements or representations, and no waiver of, or change in any terms herein shall be binding on Seller unless in writing and signed by Seller. No third party shall enjoy the benefits of these Terms nor shall have any rights under this Online Store Policy.

Miscellaneous 
Purchases made at this Site, and this agreement shall be governed by, construed under, and interpreted in accordance with the laws of the State of California. To the extent that the terms of this Online Store Policy may vary from the Uniform Commercial Code of the State of California, the provisions of this Policy shall govern. To the extent that any provisions contained in this Policy shall be determined to be unenforceable, all other provisions shall remain in full force and effect and the affected provisions shall be construed, as to be enforceable to the maximum extent permissible by applicable law.

Errors on Our Site
Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and we reserve the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account.

Processing Your Order 
Orders received by 9:00 AM PST, Monday through Friday, will be processed same-day and shipped the following business day.

Orders received after 9:00 AM PST, Monday through Friday, will be processed the following business day. Once your order is processed, it will be shipped the following business day. For example, an order received at 1:00 PM on Monday will be processed on Tuesday, and the order will be shipped on Wednesday.

Order Changes or Cancellations
Changes to your order or the delivery address for your shipment must be submitted within two (2) hours of placing your order to G3.Order@G3Enterprises.com. You will incur a charge of Twenty U.S. Dollars ($20) per change for any modifications made to your order after the two (2) hour window has expired.
